A Canute man is facing up to a year in prison following his June 23, 2019, arrest. James Douglas Hoffman II was arrested on a misdemeanor charge of domestic assault and battery in the presence of a minor following an incident at his former girlfriend’s residence.
Deputy Russell Stewart of the Washita County Sheriff’s Office was dispatched to the Canute residence of Dana Mims at approximately 4:17 p.m. Sunday, June 23, 2019, based upon a 911 call reporting three male subjects at the residence, one of whom had threatened her 14-year-old daughter.
“Dana said her and her boyfriend had been feuding for the past couple of days and this morning was no different,” Stewart wrote in the affidavit of probable cause. “Dana said she kicked James Douglas Hoffman II out of her home yesterday and locked the door so that he could not get back in due to his violent anger issues...Dana stated further that when James’s dad (Doug Hoffman) and brother (Joey Hoffman) showed up to get James she confronted them saying James had taken property that belonged to her and her girls and wanted it returned. Doug Hoffman then walked over and got right in Dana’s face and Dana told him to leave the property and that’s when Doug said he was going to beat her ass with his fist raised. Dana said then Doug pushed her back and Dana punched Doug. [Minor child] saw what happened and went rushing to her mother and James Hoffman grabbed [minor child] by the throat with both hands and choked her, [child] fought James off and he grabbed her a second time with one hand and choked her. [Child] managed to get away from James the second time and that’s when Dana and [child] retreated into the house.”
The Hoffmans left the scene before Stewart arrived. They reportedly contacted the Elk City Police Department so Doug could file a complaint against Mims for punching him during the altercation. Stewart requested the Elk City Police arrest Hoffman on a charge of domestic assault and battery by strangulation.
If convicted on the filed charge, a misdemeanor offense, Hoffman could be sentenced to a term of not less than six months and not more than one year in prison and/or a fine of up to $5,000.
